Shouldn't all of these legal decisions have been made BEFORE Tofino council decided to "opt in"?
What's going to happen now if the court rules that these purpose-built vacation rental units are indeed exempt from provincial legislation? Owners at Tibbs and Eik, along with their lawyers, are no doubt hopefully anticipating the court's ruling.

Then the lawsuits can begin......

Ucluelet council voted to "wait and see" regarding this issue. Ucluelet taxpayers will not become embroiled in any legal quagmires.
Tofino mayor and council voted to jump in with both feet, even though all the facts weren't yet known as to how all this would work in the end.

Those five people in Tofino council chambers that decided to take the whole issue on without reasonable forethought are going to realize that this entire charade is about the Hotel Association protecting their turf, not about housing for people. Tofino taxpayers are going to get the bill.

Forget the Hotel Association if you need to identify your enemy. Tofino residential taxpayers have been getting the bill for decades. How do these "purpose built vacation rentals" as you describe them,( I assume you are referring to "Tibbs and Eik St.), not pay commercial taxes? Many units provide no residential use whatsoever. Whether they win out on the current law suit, or not, there needs to be a follow up law suit to protect the fairness of the Municipal tax system ( ie protect the interests of residential property owners and others who want fairness in the municipal tax system.
