  1. So, what happens when those fines are upheld by the adjudicator? They pay them, and the city can now shut them all down for operating nightly rentals?

    I just noticed now that TVR has the SC condos back online, this time with a 30 night minimum...

Interesting that these are all properties that were operating before long 2005 and might have legal non conforming use protection....why is Tofino bylaw wasting taxpayers money and going after these properties while ignoring all the Tofino owners that are still advertising illegal VR,s on Air B n B and VRBO...that all came after the 2005 VR bylaw? Would be slam dunk and no non conforming use ...what a waste..$$$$$$...

  3. the court might have a problem with the VR bylaw allowing a non resident commercial use of all residential properties.
    a caretaker requirement doesn't satisfy a home occupation if the vacation rental is the occupation of the owner who doesn't live there

  9. They’re not targetting anyone more than anyone else. Many more fines than this were handed out, and even more warnings. Some paid the fines and cleaned up their act. Grice and Prescott were just the ones that disputed the fines instead of complying with the rules, that’s all, so they end up in the adjudication process. It’s just greed and the fact that they felt entitled to continue running the illegal rentals that they’ve been running for years.

  12. You folks really have it in for the poor operators of the Clinton Café. All they want to do is run a good clean educational facility. For the children. Can't you see, it's for the children of the world. And it's for the old people too. Now I see it's for the old people as well. what could be wrong with that. And with saving the earth from destruction and evil. It's Gods work I say. God bless these humble folk who do this work. People who give so much back to the earth and the children and the aged. People who plant vegetables and plants and stuff. People who place their hands on the earth, and bring forth abundance. Praise the Lord I say. Let us kneel and pray together.

  13. Have you ever noticed that people in which karma has caught up with them... think of themselves as victims.

    This is not about penalizing entrepreneurial people who have supported the local tourism industry, paid the taxes asked of them, and brought benefits to the community as a whole. There's something else going on here, something more of a personal nature.

    For most of the people on that list, if you hadn't been such insatiably greedy assholes overall, the future of your South Chesterman Estate Home investment vehicle(s) probably would have had a better outcome.

    And now the great unwashed is standing outside your front door bearing pitchforks and tiki torches...and they want in.

  17. Why are the airb&b and vrbo listings getting the free willie treatment from bylaw and then they go and target local management co's...who are collecting the hotel tax by the way and hiring lots of locals too... don't get it..sad..

  18. Air bnb and vrbo listings aren't getting the free willie treatment. Most of the illegal rentals on air bnb have already been targeted, fined, and removed. A bunch of those listings were being maintained by the local management companies anyways.
    I recently also was told that one of the local management companies doesn't even have a licence from the District to manage properties. They've been masquerading as a stand-alone VR, not a management company, that is itself pushing the limits of the law. Shut them down!

  20. I would like to go on record to say how much we enjoy the Tofino Botanical Gardens and the property in general. It's pretty much the best place to take kids to play and explore in this town. Its a quieter and more peaceful town green. No drunks and rude frippies chain smoking around the kids. We are lucky to have access to it.

  21. Nobody will disagree that it is a great property. Having said that ,even Trump’s Mar-a-Lago obeys local zoning bylaws and pays property tax on an assessment based on its actual use.
